Introduction<\/strong><\/p><p>Welcome to India Car Mall \u2013 India\u2019s trusted platform for salvage, repossessed, and auction-grade vehicle sourcing. These Terms &amp; Conditions govern your participation in any auctions conducted by India Car Mall, hereafter referred to as &#8220;the Company.&#8221; By registering and participating in our auctions, you agree to be bound by the following terms without limitation or qualification.<\/p><div><hr \/><\/div><p><strong>2. Eligibility &amp; Dealer Registration<\/strong><\/p><ul data-spread=\"false\"><li><p>Only verified dealer partners may register and participate.<\/p><\/li><li><p>Dealers must provide valid documentation including PAN Card, Aadhaar Card, GST Certificate (if applicable), Cancelled Cheque, and Active Mobile Number &amp; Email ID.<\/p><\/li><li><p>Registration is valid for 1 year and subject to renewal.<\/p><\/li><li><p>The platform is not open to retail buyers or general public.<\/p><\/li><\/ul><div><hr \/><\/div><p><strong>3. Auction Participation &amp; Bidding Rules<\/strong><\/p><ul data-spread=\"false\"><li><p>Only registered dealers can access live auctions and \u201cBuy Now\u201d vehicles.<\/p><\/li><li><p>Each bid submitted is legally binding and cannot be cancelled or modified once placed.<\/p><\/li><li><p>Bids must be placed during the valid auction window. Late bids will not be considered.<\/p><\/li><\/ul><div><hr \/><\/div><p><strong>4. Earnest Money Deposit (EMD)<\/strong><\/p><ul data-spread=\"false\"><li><p>To maintain auction integrity, India Car Mall mandates an Earnest Money Deposit (EMD) prior to participation.<\/p><\/li><\/ul><p><strong>What is EMD?<\/strong><\/p><ul data-spread=\"false\"><li><p>EMD is a mandatory deposit submitted as a token of serious intent to bid. It helps prevent frivolous participation and ensures only committed buyers are engaged.<\/p><\/li><li><p>We do NOT accept Bank Guarantees.<\/p><\/li><li><p>In rare cases, Demand Drafts may be accepted at our discretion.<\/p><\/li><li><p>EMD may be:<\/p><ul data-spread=\"false\"><li><p>A fixed amount, OR<\/p><\/li><li><p>5% to 10% of the bid value, based on the type and condition of the vehicle.<\/p><\/li><\/ul><\/li><\/ul><p><strong>Refund Policy:<\/strong><\/p><ul data-spread=\"false\"><li><p>EMD will be refunded to all unsuccessful bidders after bid evaluation.<\/p><\/li><li><p>For successful bidders, the EMD is converted into a Security Deposit (usually 10% of the final bid).<\/p><\/li><li><p>If a successful bidder fails to honor the bid or delays the lifting, the EMD will be forfeited without exception.<\/p><\/li><\/ul><div><hr \/><\/div><p><strong>5. Bid Confirmation Policy<\/strong><\/p><ul data-spread=\"false\"><li><p>By submitting token money or an Earnest Money Deposit (EMD), you are confirming your bid for the selected vehicle.<\/p><\/li><li><p>In cases where a prior security deposit has already been made, a verbal confirmation\u2014either via phone call or voice note\u2014will be considered legally binding to secure the deal.<\/p><\/li><li><p>While our team may request a written confirmation through WhatsApp or email for documentation purposes, please note that we will not delay action awaiting such confirmation. Once the token\/EMD is received or a verbal go-ahead is given, the bid is deemed confirmed and the process to secure the vehicle begins immediately.<\/p><\/li><\/ul><p><strong>\ud83d\udd12 Why This Policy Matters<\/strong><\/p><p>In the fast-paced salvage and auction market, even a short delay can result in losing a vehicle to another buyer. This policy enables us to act swiftly on your behalf, securing your chosen vehicle without unnecessary waiting, and ensuring your interests are protected at all times.<\/p><div><hr \/><\/div><p><strong>6. Physical Inspection &amp; Vehicle Condition<\/strong><\/p><ul data-spread=\"false\"><li><p>All vehicles are sold on an \u201cAs Is, Where Is\u201d basis.<\/p><\/li><li><p>Dealers are strongly advised to conduct physical inspection prior to bidding.<\/p><\/li><li><p>India Car Mall shall not be liable for:<\/p><ul data-spread=\"false\"><li><p>Missing accessories (Stepney, Battery, Tools)<\/p><\/li><li><p>Post-inspection damages<\/p><\/li><li><p>Removed aftermarket parts or security features<\/p><\/li><\/ul><\/li><\/ul><div><hr \/><\/div><p><strong>7. Payment Terms<\/strong><\/p><ul data-spread=\"false\"><li><p>Full payment must be made within 48 hours of auction approval.<\/p><\/li><li><p>Delay in payment or documentation will result in cancellation and EMD forfeiture.<\/p><\/li><li><p>All applicable taxes, insurance, and RTO transfer charges are to be borne by the buyer.<\/p><\/li><\/ul><div><hr \/><\/div><p><strong>8. Vehicle Pickup &amp; Delivery (Lifting Policy)<\/strong><\/p><ul data-spread=\"false\"><li><p>Vehicles must be lifted within 3 working days from the date of payment.<\/p><\/li><li><p>In special cases, lifting timelines may vary as per insurance company instructions. These timelines will be communicated clearly.<\/p><\/li><li><p>Delayed lifting beyond the stipulated window may incur penalty charges or towing\/storage fees.<\/p><\/li><\/ul><div><hr \/><\/div><p><strong>9. No Bid Cancellation or Re-negotiation<\/strong><\/p><ul data-spread=\"false\"><li><p>No bid cancellations are entertained post-auction expiry.<\/p><\/li><li><p>No request for revision of amount or withdrawal will be entertained.<\/p><\/li><li><p>All bids are considered legally binding offers valid for 30 days.<\/p><\/li><\/ul><div><hr \/><\/div><p><strong>10. Adjustment of Deposits for Regular Dealer Partners<\/strong><\/p><ul data-spread=\"false\"><li><p>India Car Mall works closely with auction houses, insurance companies, and surveyors. We are often required to deposit large sums on behalf of dealers to secure priority deals.<\/p><\/li><li><p>In rare cases, if a refund is not possible, the deposit will be adjusted in future transactions.<\/p><\/li><li><p>In good faith, partial refunds may be offered based on the buyer\u2019s ongoing relationship.<\/p><\/li><li><p>To ensure long-term collaboration and seamless settlement, we only work with consistent dealer partners.<\/p><\/li><\/ul><div><hr \/><\/div><p><strong>11. Blacklisting &amp; Legal Action<\/strong><\/p><ul data-spread=\"false\"><li><p>India Car Mall reserves the right to blacklist or ban any dealer for:<\/p><ul data-spread=\"false\"><li><p>Repeated default in payment<\/p><\/li><li><p>Abandonment of approved vehicles<\/p><\/li><li><p>False claims or disputes regarding vehicle condition or refund<\/p><\/li><li><p>Harassment of staff or auction agents<\/p><\/li><\/ul><\/li><li><p>In such cases, legal action may be initiated, and any outstanding deposits will be forfeited.<\/p><\/li><\/ul><div><hr \/><\/div><p><strong>12. Platform Usage Disclaimer<\/strong><\/p><ul data-spread=\"false\"><li><p>India Car Mall is not responsible for system downtime, connectivity issues, or bidding delays due to third-party services or dealer-side errors.<\/p><\/li><li><p>While we strive for accuracy, vehicle images and details are for reference only and may not always match exact condition.<\/p><\/li><\/ul><div><hr \/><\/div><p><strong>13. Privacy &amp; Data Protection<\/strong><\/p><ul data-spread=\"false\"><li><p>Dealer information is stored securely and used only for operational, logistic, and compliance purposes.<\/p><\/li><li><p>We do not share or sell dealer data with third parties without consent.<\/p><\/li><\/ul><div><hr \/><\/div><p><strong>14. Dispute Resolution<\/strong><\/p><ul data-spread=\"false\"><li><p>Any dispute shall be resolved amicably, failing which it will be subject to arbitration under Indian Arbitration Act.<\/p><\/li><li><p>Jurisdiction: Delhi NCR, India<\/p><\/li><\/ul><div><hr \/><\/div><p><strong>15. Right to Amend Terms<\/strong><\/p><ul data-spread=\"false\"><li><p>India Car Mall reserves the right to update or amend these Terms &amp; Conditions at any time without prior notice.
